First of all, if you are a tenant i.e. live on rent, then the landlord can no longer ask for 6 months' advance rent from the tenant. According to the new rules, only 2 months' rent can be taken as security. Whereas in commercial, advance rent up to 6 months can be taken as security. The most important legal protection tenants will get is against rent increases. Because according to the new rules, it will now be necessary for landlords to give notice before increasing the rent. This will prevent arbitrary rand appreciation. The process of suddenly removing the tenant has also been stopped now. Because in this process, i.e. according to the new rules, the house cannot be vacated. For this, landlords will first have to complete the entire process of giving notice very quickly. And if we talk about landlords, the biggest change has happened for them on the tax front. In the new rules, the limit for TDS deduction has been increased from ₹400 to ₹6 lakh. Which directly means that now landlords will save more income because TDS will not be deducted. If the tenant does not pay the rent for 3 months or more, the landlord can take the matter to the tribunal. Earlier it used to take several years after which the cases used to go to the tribunal. You will get all these legal protections only after registering the rent agreement. Under the new Act, it will now be mandatory to register every rent agreement within 2 months. Registration can be done in two ways. The first is to register it by visiting the online property protection website of any state or the nearest registrar office. Let us tell you that if you do not complete the registration of your rent agreement within the stipulated time i.e. within 2 months, then a fine of ₹5000 can also be imposed. Special rent courts and tribunals have also been created to expedite the resolution of disputes between tenants and landlords. Where the target will be to resolve the disputes within 60 days.
